Okay, let's leave all that stupid rubbish behind, someone is just trying to derail this forum and our discussions,.

Does anyone here know what this appeal involves.  Is it a proper court case again, or just a short hearing and a judge then decides.  I did see in the paper that the McCann's would have to travel to Portugal.  Will they have to give evidence all over again, or will it be the old stuff that is looked at by the Judge.  

Also what sort of time span are we talking about with this appeal, just a day, or days etc.?

Are members here feeling positive or having doubts?

Surely the McCann's wont need to go to Portugal for the appeal. I expect they will find it difficult not to though, how could they miss the opportunity to again show the world what a monster Dr Amaral is, for forcing into that oh so tiresome task of arranging childcare. Rolling Eyes

I'm beginning to think that the Mc's will be extremely quiet from now on in.

Even with the appeal stuff.

I genuinely think they know they're running out of time and they can't escape the net that's closing.

Bit like a rat (see other thread).

As I have posted before I like to read tweets from N.M. (Algarve). These four tweets are all from the 4th sept. They may be relevant.

Speculating under pressure the judge ruled in favour of the #McCann but in a way that is easily arguable by the Appelate Court.

I'm convinced that the initial Judge (intentionally) gave rope for a positive outcome for this appeal.

The contents of the Appeal remain secret until there's a resolution, so we don't know what is being contested. My guess: all of it.

When we read the transcripts of the Trial and the "Materia de Facto" it's clear there wasn't 1 single material/objective evidence.

With the McCann hashtag on Twitter plastered with porn and the recent desperate attempts to shut down Operation Grange, you can almost taste the panic. IMO.

It's not a hearing. Just like last time, when the book-ban was overturned, the judge[s] in chambers will study the case, the original verdict and the appeal. Last time that worked out very well. The McCanns appeal was thrown out & Dr. Amaral won his case. I'm very positive ;-)

The appeal will be heard on points of law and although arguments on matters of fact are not normally permitted, this case is different. The "award" to McCanns of £357k was for alleged damages caused by Snr Amaral's book.
The Court of Appeal and indeed the Supreme Court both determined in 2010/2011 that any and all damage the McCanns may have suffered was either to be expected in the circumstance of "losing" a child and as in the purported "invasion of privacy", wholly self inflicted. That those determinations were made in the separate injunction case is immaterial. Evidence is evidence, damage is damage and NOTHING has changed.
The alleged damage remains the same and yet for reasons that no sane person can fathom, a judge in a lower court took it upon herself to countermand the findings and indeed logic of the Court of Appeal in finding for the McCanns.
At the time that risible decision was handed down, Goncalo was finished and in legal terms, "dead and buried" and there can be no doubt that the McCanns and the judge were fully aware that he simply could not afford to appeal it.
It's called a "fait accompli" and those responsible for it must have been tittering all the way to their 5* hotel.
Then however, a certain young lady from Birmingham came down the track and galvanised all of us good people who actually give a damn about justice for an honest man, to dig into our wallets and purses to give Goncalo a fighting chance.
The position now is quite clear. For Goncalo's appeal to fail and for the McCanns to escape what will be ruinous counter litigation, the Court of Appeal and the Supreme Court judges must all come to the conclusion that in 2010/2011, they got it wrong.
No new evidence will be presented because there is none.
It is however fair to say that to a man ( and woman ) all of these judges are Portuguese and are well aware of the relentless vilification of their country and it's people by not only the McCanns but the MSM who support them out of a fear not to.
What will happen when the appeal is heard ? It's not even a moot point and It is no surprise that the McCann supporters have done everything in their extremely limited power to prevent it happening. An epic fail.

Surely the results of GA`s Appeal could be due soon - it was started nearly 3 weeks ago. Wonder how long these things usually take.

As far as I am aware from MCF, there is no time limit so we just have to be patient. Hope it's soon though for GA's sake!

Hope so too. Just wondered if the latest flurry of media nonsense was because the Mcs had heard bad news on that score.

Just adding this bit here from The Portugal Resident as it relates to the Appeal. Looks like it could go on for years !

"For now, the decision by judges at Lisbon’s Appellate Court on Amaral’s appeal against the €500,000-plus damages awarded against him in the civil action taken out by the McCanns over his book “A Verdade da Mentira” is due any day.

But the source explained to us that if the appeal is upheld - that is, if Amaral “wins” and at last sees his assets unfrozen after six years of litigation - “the McCanns will almost certainly appeal”.

“The next step would be an appeal to the Supreme Court, and then even to the Constitutional Court,” said the source.

And should Amaral lose the fight, which he feels centres on his right to freedom of expression, then a new online appeal will be needed to fund a case against Portuguese justice in the European Court of Human Rights."

So we are now into February and still not a sniff of any news re this appeal!  I know it was said it could take time, but how long does it take for judges to look at a case.  Goncalo now has this huge fund to help him, yet there seems to be no news from anyone.  I don't know about others but it is all so frustrating this waiting all the time.....

I feel the same Candyfloss, why is it taking so long. Its just so quiet (too quiet in my opinion). There has been speculation that the decision will be reached in February?.
