Can you explain what the "grandfather rule" is?

ETA I just googled a bit and understand that new rules only apply to new situations/cases. Is that correct?

That's it, yes. The wording in the articles like "could have" seem to suggest that may be the case.

To give a personal example: I can't driver a small lorry on my driving licence but my older brother and dad can.

Just wondering if this is the political interference Amaral referred to also Mi5,they would have known about the calls and text's,I guess we'll soon know if there are new developments,until then its any ones call

It says it could have helped back then and if you believe the media there was a lot of evidence. Well of course if there was anything then it would have helped, but it could not be used back then. 

 Now, different kettle of fish, the case has been reopened, new investigators and two countries.... so I would imagine it may apply?

Absolutely, Candyfloss. I think I'm right that some of the withheld evidence is to do with calls/text? If so, then right there could be new evidence.

Just a thought it was reported only last week the BHH was insisting the investigation would continue he also went on to say.

Sir Bernard said of the investigation: “It’s moving on apace at the moment in terms of the relationship with the Portuguese and that is to be welcomed. As long as there’s a basis for doing the investigation we will continue.”

in light of the ruling is this what he was referring to?

I'm feeling extra optimistic today with all this phone stuff.

I've had an interesting thought. If the new ruling does allow an opportunity for the text messages to be used in the McCann case, would the McCanns' lawyer challenge it? And if so, what kind of message would that in itself send? McCanns don't want "private" messages to be seen by the investigation? I await the next steps in this case. Perhaps this is what the investigation has been waiting for...knowing this ruling was in the works?

The phone records does seem an important part in this, fingers crossed.

Redwood was telling us back in 2013 that the phone records were being checked.

If you sit back and try to work out all that has happened in the last few weeks it does seem to make some sense. The
ruling against Dr. Amaral enabling him to appeal, his mention of suing, the gofundme which almost certainly should reach the target, not to mention the publicity it could bring, and the news of the phone records, this might just be a win win situation. Finally didn't Kikoratton send a report of the calls to the P.J. Hopefully good times ahead.

Could I go further and pull a suggestion (wishful thinking..) out my butt. The GA trial result was "manufactured" so the case could move on at "apace"?

Because reading more of what the judge has based her decisions on is giving me an ulcer.

I think the trial was manufactured hopefully for the right reasons. Just my thoughts Dr.Amaral seems a bit more confident now.

The reasons I suggest it is because GA seems so calm and laid back considering how "bad" things are. In the early days he was rightly pretty damn angry and showed that.

I just hope it is the home stretch now.

Can't see what the timing as to do with it,Amaral V McCann has been going on for 6yrs,it can't possibly suggested its taken this long with a manufactured verdict because it suits the PJ/OG,there is either enough evidence to bring it to a conclusion or there is not.
If the sms and phonecalls evidence can be used then there might be some progression.
